| 摘 要： | 经济的低迷,生态的破坏是资源枯竭型城市面临的两大困境,构建全面的生态补偿机制成了其和谐发展的必然选择。然而,现行的资源利用及环境保护制度不能满足资源枯竭型城市的法律需求。不同类型城市生态补偿的法律界定内涵不尽相同,资源枯竭型城市应当采用广义的界定方式。生态补偿法律关系是法律制度的事实演绎方式,是将静态的法律制度与动态的社会生活连接的转换器。

| Abstract: | Building a comprehensive ecological compensation mechanism is the inevitable choice to the harmonious development of exhaustible-resource-style cities for the economic downturn and the ecological damage.However,the existing law of resources and environmental can not meet the resource-exhausted cities wants.The broad definition of ecological compensation mechanism shall be adopted by the exhaustible-resource-style cities for different legal definition of ecological compensation mechanism to different types of urban.Legal relationship of ecological compensation is the reflection of the legal system in our social,which is the connected converter between the static legal regulations and the dynamic life. |
