论行政行为的先定力

目前学界对行政行为先定力的两种理解均存在不少值得质疑之处。先定力不是行政行为的效力,只是行政权的"力",并贯穿行政行为作出程序的始终。必须厘清先定力与行政行为效力之间的区别和联系。先定力起因于秩序行政,因而,应随给付行政模式的拓展而弱化和消失。

Study on the Previous Force of the Administrative Act

There are many questions that should be investigated for the two understandings about the previous force of the administrative act in the current academic circles.The previous force is not the force of the administrative act,but only the"force"of the administrative authority.It acts through the administrative procedures always.The distinction and connection between the previous force and the force of the administrative act must be clarified.The binding force originates from the order administration,so it should weaken and disappear for the expansion of administrative supply style.
