论三重框架下的劳工标准问题

劳工标准问题是世界各国尤其是发展中国家所必须面对和解决的重大问题。在我国已有的分析框架中 ,劳工标准问题往往被还原为贸易壁垒问题而加以“规避”、“应付”或提出“对策”。本文试图换一种思路 ,在国际劳工组织、世贸组织和全球经济—社会平衡发展的三重框架下透析和审视劳工标准问题。主要论及 :国际劳工标准产生的历史缘起以及因其“软法”的品质难以胜任强行推广核心劳工标准的重任 ;核心劳工标准与贸易的密切关联性以及贸易制裁与核心劳工标准挂钩的合理性及评价 ;重点分析了全球经济—社会平衡发展框架下的劳工标准问题 ,认为核心劳工标准的强行推行 ,有助于解决全球范围内经济、社会发展不平衡问题 ;最后论述了核心劳工标准对中国经济和社会发展的重大意义。

On the Fundamental Labor Standards under the Three Frameworks

Labor standards issue is a worldwide focus. In the existing analysis framework, domestic scholars tend to ascribe the labor standards issue to a trade barrier and lodge such as "elusion", "dealing with", "countermeasure" to cope with it. The thesis tries to turn to a new route: to analyze and examine the labor standards issue at one time under the three frameworks of ILO, WTO and globally balanced economy-society development. The thesis mainly concerns: the historical origins of the labor standards and the ILO's impotent in realization of the fundamental labor standards due to the "soft law" identity of the labor standards; the close connection between the core standards and trade; and the rationality of the imposing of trade sanction links up with the observance of fundamental labor standards and its evaluation; especially attaches the great importance to the fundamental labor standards under the framework of globally balanced economy-society development, considering forced introduction of the fundamental labor standards worldwide will be helpful to the solution of the current globally imbalanced economy-society development issue; Finally the thesis discusses the significance of the fulfillment of the fundamental labor standards to China's healthy development of economy and society.
