| 摘 要： | 对法律的制定有建构论唯理主义和法律进化论两种根本对立的观点。本文在对这两种理论进行综合分析的基础上,提出了一种折衷的观点,即以法律进化论为本体,辅之以适度的建构理论,实行“科学的法律进化论”,并以此为认识论的基础,对中国民法法典化中的一些问题提出了自己的一些看法,以期对目前进行的民法典制定有所裨益。
