论我国刑事证明的最高标准之重构

证明标准是证据制度中证明理论的核心内容,也是司法实践中证据运用的首要问题.作为指导和规范刑事证明活动准则的刑事证明标准,应当根据刑事证明逐步深入的特点,构建出由低到高"阶梯式"的层次性证明标准.作为刑事证明的最高标准,即有罪判决的证明标准之确立,是近年来学界争论的焦点.因此,深入研究证明标准的涵义,比较两大法系刑事证明的最高标准,分析国内有关刑事证明标准的各种学说,反思我国有罪判决证明标准的立法规定,以期重新构建顺应时代发展潮流、符合我国刑事司法实际情况和需要的科学、理性、可操作性的刑事证明的最高标准.
