| 摘 要： | 大陆法系将诉讼时效的客体规定为请求权， 而英美法系将之规定为诉权。我国民法乃继受大陆法系传统， 因此， 其诉讼时效客体应是请求权。

| Abstract: | The object of the limitation of action in the continental legal system is stipulated as the right of a claim, however, it is the legal capacity to sue in the American British Legal system. Since Chinese Civil Law has accepted the tradition of the continental legal system, the object should be the right of a claim. |
