| Abstract: | Inquiring into historical documents of ancient China, this paper works for ascertaining the dominant differentiation of civil law between western and ancient China and holds that it is admittedly important to absorb the quintessence of western civil law in the period of Chinese modernization, but it is even more essential to pay close attention to the Chinese traditional civil law culture. |
