反贫困法律问题研究

反贫困是一项复杂的社会系统工程。中国贫困问题的产生有其法律制度性根源。反贫困斗争的长期性和艰巨性要求法律机制的介入。反贫困立法属特别立法 ,应以对农村特殊贫困群体的救济和农村扶贫开发过程中发生的社会关系为调整对象 ,以实现权利义务在相关主体之间的合理配置和反贫困工作的规范化、制度化和法治化。

Research on the Legal Problems of Anti-poverty

The anti-poverty is complex social systematical engineering. The production of poverty in China has its legal institutional origins. The anti-poverty is a long-term and arduous struggle that demands the introduction of legal mechanism. As a special legislation, the regulative object of the anti-poverty legislation should be the remedy of particular poverty society and the social relations producing in the course of poverty assistance in the rural areas so as to realize not only the reasonable distribution of rights and duties among the relative subjects but also the normalization, institution and rule by law of anti-poverty works.
