最高人民法院民商事司法解释溯及力问题探讨

司法解释作为人民法院的裁判依据,并不限于纯粹解释法律的层面,且通常对法律的溯及力问题予以规定。民商事类司法解释的制定与司法适用情况表明,有关溯及力问题的规定是混乱的,理解与适用也是混乱的。这有悖于统一司法尺度的宗旨,甚至影响法制的统一。最高人民法院应加强自律并形成系统完善的溯及力判断规则;全国人大常委会也应将司法解释的溯及力作为备案审查的重点,并且注重对民商事立法自身溯及力做专门规定。
