共享经济的法律规制逻辑——以网约车行政案件为切入点的分析

以网约车为代表的共享经济法律规制在现实中存在地方立法违背中央立法、选择性执法、法院机械司法等问题,规制逻辑存在三次断裂。对共享经济的法律规制逻辑应当明确规制目标、主体、时机、手段与形式。其中,规制目标包括合法性规制等共性规制目标与乘客安全等个性规制目标,规制主体包括政府与网络平台,规制时机按不同规制目标分为不同的介入时机,规制手段应在规制目标的分层和明确下配套有效和匹配的规制手段,对共享经济有效的规制形式包括试验性规制与合作规制。共享经济与现有法律制度的融合还应摒弃机械适用合法性标准的法律实践与规范法学理论,现代法律的德性转向有助于减少共享经济等新兴事物与现有法律制度的裂痕。

The Logic of Regulating Sharing Economy: Based on Analysis of Administrative Cases of Online Booking Cars

Legal issues exist in the regulations of sharing economy represented by online car-hailing,in reality,namely,local legislation against central legislation,selective law enforcement,indiscriminately applying law to facts,resulting in the breakdowns of these three areas in terms of the logic of regulation. The legal regulation logic of the sharing economy should specify the regulation objective,subject,timing,means and form. The purpose of regulation include legal regulation,as a universal regulation target,and a particular target such as passenger safety.The regulation subject includes government and network platform,regulation timing can be divided into different phases according to different regulation targets. And those means of regulation,shall be equipped with effective and appropriate methods of regulation with specified targets,and those types of regulation,which is pro-sharing economy includes experimental regulation and cooperative regulation. The combination between sharing economy and existing legal system requires to quit indiscriminately applying to legal standards or standardize legal theory,The aretaic turn of modern law is helpful to achieve harmony of sharing economy and existing legal system.
