论格老秀斯法权思想的人本化因素

On the Human-Orientated Factors in Grotius’ Legal Right Thoughts

Grotius’s thoughts represented the best feature of human thoughts.As the founder of international law,the legal right thoughts of Grotius cover natural law,international law and jus gentium,which are constructed as the basic legal structure for world order in 17th century.In addition,the human-orientated factors had already been manifested in Grotius’ masterpieces,such as War and the Law of Nations and The Free Sea.This article is aimed to analyze the contents of human-orientated factors within Grotius’s legal right thoughts,such as humanism,just,freedom,moral and universalism,by virtue of discussing Grotius’ idea about natural law and international law theory.Moreover,providing some reference for China’s social rising and transformation.
