《监察法》实施中的若干问题与完善建议

我国《监察法》的正式颁布和顺利实施对于深入推进全面依法治国、有效促进反腐败法治化进程具有重要意义和重大影响。实地调研主要聚焦我国《监察法》实施中的四方面内容:监督权限制度、监察建议制度、监察赔偿制度和特约监察员制度。从国家监察体制改革法治化进程角度考量,应从以下途径予以完善:首先,建议明确监察机关的监督方式以及厘清内设机构的监督职权;其次,建议明确监察建议的基本内涵、主要内容和适用程序三方面内容;再次,建议明确监察赔偿的概念内涵、归责原则、构成要件与具体程序;最后,建议从国家立法层面制定专门的《特约监察员法》,统一规范特约监察员的选任条件、职责范围、职务保障等。

On Several Problems of the Implementation of the Supervision Law of China and Its Improvement

The Formal promulgation and smooth implementation of the Supervision Law of China is very important for promoting the Comprehensive Rule of Law deeply and the Process of Ruling by Law against Corruption.Through field research,focus on the four aspects in the implementation of Supervision Law of China:the system of Supervisory Power,the system of the Supervisory Suggestion,the system of the Supervisory Compensation and the system of the Contractual Ombudsmen.In the view of the legalization of reform of National Supervision System,suggestions for improvement are as follows:firstly,advise defining the supervision mode of supervisory organs and clarifying the supervisory authority of internal institutions;secondly,advise defining the Supervisory Suggestion of basic connotation,main contents and applicable procedures;thirdly,advise defining the Supervisory Compensation of basic connotation,doctrine of liability fixation,constitutive requirements and applicable procedures;at the last,advise the enactment of the Law on Contractual Ombudsmen and defining the Contractual Ombudsmen of prerequisites,scope of responsibility,official guarantee.
