实用主义视角下的司法观及启示——从法律发现说起

法律发现始终难以摆脱司法中"创造"的成分对它的影响与责难。单纯的逻辑演绎并不能确切地表述司法过程的现状,价值判断总是参与其中。实用主义法学所蕴藏的立场界定和方法选择则为破解这种困局提供了"良方"。其司法观可以概括为:以"逻辑"传递着对"发现"的尊重;以"经验"护佑着对"创造"的追求。

The Judicial View and Its Enlightenment from the Pragmatism Perspective --.Starting from Finding of Law

The finding of law has always been affected and denounced by the ＂making of law＂ in judicial process. Mere logical deduction cannot explicitly express the judicial process since value judgment is always involved in. The stance and approaches of pragmatism jurisprudence can offer effective solution to this dilem- ma. The judicial view of pragmatism can be summarized as： the ＂logic＂ shows respect to the finding of law While ＂experience＂ blesses the pursuit of making of law.
