技术网络化背景下的专利侵权判定——以云计算技术专利权为视角

以云计算为代表的技术网络化趋势对专利侵权判定规则及其适用带来了新的挑战。网络化技术实施过程中的分离式侵权行为和跨境侵权行为均难以根据现有规则被认定为专利保护范围,并由被告承担侵权责任。方法专利举证责任倒置规则也难以在网络化技术专利侵权诉讼中为权利人带来有效的救济。专利权人获得司法救济的法律障碍在制度设计时未能有效预见和应对,导致维权难度较传统技术领域显著增大。因此,必须克服专利侵权判定中的形式主义,以实质性侵权作为判定侵权行为成立的价值取向,以期克服由于网络化技术发展而带来的利益平衡格局遭到破坏的状况,实现专利制度的价值和目标。

The Patent Infringement Judgment in Networking Technologies --from the Perspective of Patent on Cloud Computing Technology

The trend of networking technologies represented by the cloud computing has brought new chal- lenge to rules on patent infringement judgment and their applications. The divided infringement and extraterri- torial infringement in the operation of networking technologies can barely be subject to patent protection scope in accordance with current rules, thus the defendant can escape the tortious liabilities. The reverse burden of proof doctrine in the process patent also fails to offer effective relief for patentees in networking technologies. The legal obstacle of remedies for patentees could not be foreseen and coped with during legislation, resulting in more difficulties for patentees than in traditional technology fields. Thus the formalism in patent infringe- ment judgment should be overcome and the substantive judgment on patent infringement should be applied as the goal of value, so as to correct the imbalance of interest caused by networking technologies and to accom- plish the aim and value of patent system.
