In the iPad case , to determine whether “white glove” transaction should be fraud , the key is whether concealing the true identity of buyer violate the principle of good faith .The dogmatics of “good faith”apparently can ’ t solve this problem .The effectively alternative approach is the economic analysis to the possible consequences caused by different verdict scheme .The legitimacy of the “white glove” transaction is to withhold “hold-up”, to reduce negotiation costs and facilitate efficient trading .The logic of economics is not contrary to“good faith”,and provides more effective knowledge and principles to determine whether some con-cealing violates “good faith”.
