中国司法与民意的沟通——基于主体间交往理性的认知

考察中国传统司法活动特质、民主革命时期司法活动特质、西方司法活动特质,今日之中国司法仍然徘徊在情理与国法之间,面临着司法的六重困局,力求通过主体间交往理性的认知以寻求脱困之思路。在三元结构下,进一步追问谁之民意,调和非理性民意,如网络暴民民意、操纵民意、偏执民意以及变调民意(仇官、仇富、侠客等),通过主体间交往理性的认知,达到沟通民意与司法的效果。通过司法中民意表达的认知机制、方法和路径选择,达成国家司法话语权和民间司法话语权的交涉和沟通,实现由舆论法庭走向制度化表达。

Communication between Judiciaries and Public Opinion in China---Based on Cognition of Communicative Rationality among Subjects

With regard to the research on features of Chinese traditional judicial activities , those in democratic revolutionary times and those in Western countries , the contemporary China ’ s judiciaries still linger over rationality and legality .The judiciaries strive for cognition of communicative rationality among subjects so as to overcome those six predicaments .In light of the ternary structure , it is necessary to further ask whom the pu-bic opinions stand for and to adjust the irrational public opinions , such as the online mob , those who manipu-late public opinions , paranoid public opinions and twisted public opinions （ namely those antagonistic against officials, rich people and chivalrous）.It is suggested to cognize the communicative rationality among subjects to achieve communication between public opinions and judiciaries .Only by means of cognition mechanism , methods and paths of expression of public opinions in judiciaries , can the interchange and communication be-tween national judiciary discourse power and public judiciary discourse power be accomplished , and thus trials influenced by public sentiment can be transferred to institutionalized expression .
