摘    要:集体建设用地入市改革是当前研究的焦点和难点问题,亟须引入新的研究视角。从法理来看,立足于土地开发权视角,允许集体经营性建设用地入市,实现集体经营性建设用地与国有建设用地的"同地、同权、同价",其本质是回归集体经营性建设用地之开发权的处分权能,以实现集体经营性建设用地之开发权与国有建设用地之开发权的法律上平等。回到土地开发权制度平台层面,借鉴国有建设用地之开发权的法制资源,加强集体经营性建设用地入市的法律制度建设,乃是当下解决集体经营性建设用地法制需求的理性选择。此外,这亦是实现城乡统一建设用地市场的内在需要。

Abstract:Reform of collective construction land market is the focus and difficulty of current research,therefore,new research perspective should be introduced.From the theory of jurisprudence and based on the perspective of land development right,permitting the collective construction land to the market for commercial purposes is to realize identical land with identical price and rights with state-owned construction land thus to return to the rights of disposition of power,and further realize the legal equality of the right to the development of collective construction land and development right of state-owned construction land.It is a rational choice to draw lessons from the legal resources of the development right of the state-owned construction land and strengthen the construction of the legal system of collective construction land market,thus solve the demand of the legal system of collective construction land.In addition,it is also the internal needs to unify urban and rural construction land market.
