试论情势变更后的行政复议审查

结合行政法的特征,将情势变更原则引入行政复议制度,有益于处理情势变更后的行政复议审查中一系列复杂的现实问题。在实体审查方面,采用利益衡量的方法,通过权衡不同利益之间的关系,判断是否应当改变审查的行政行为;在审查程序方面,按照被申请人先行处理、行政复议机关随后审查的顺序,使情势变更原则的内容得到全面、准确地实现,最终达到公共利益与信赖利益的平衡。
