| 摘 要： | 自《联合国海洋法公约》产生以来，原已存在的南海争端不仅没有得到解决，反而更趋复杂化，其原因主要是南海周边国家纷纷选择公约中某些条款，抢占南海岛礁，划分海域。根据海洋法公约有关法理内容，评析这些国家的海洋权利主张，不难看出这些国家所持依据和行为的荒谬绝伦。
