| 摘 要： | 善意取得制度是确认所有权的一种价值判断 ,是对原权利人正当权利的一种特殊情况下的否定。应该明确其适用前提 ,保持其界限的严格性 ,只有这样 ,善意取得制度才是值得遵守的 ,这项制度的发明才能真正被认为是人类理性的标志

| Abstract: | The system of bona fide acquisition is a value judgment of title confirmation, a kind of denial of original obligees' legal rights in special circumstances. The condition of its application shall be defined to keep the strictness of limitation. Only in this way, the system of bona fide acquisition is worth observing and the invention of the system can really be regarded as a symbol of human logos. |
