| 摘 要： | “现代性”在西方的古典——现代——后现代历史逻辑中,首先意味着对古典的反叛。中国的法制现代化具有不可选择性和不可逆转性,而在历史时序上它开始于“后现代”对“现代”的反思之时,内含着对传统的反叛和应对“后现代”思潮的双重使命。
