论中国村民自治制度的完善

村民自治是宪法赋予广大农民的一项神圣权利，是依宪治政的必然要求，是社会主义新农村建设的重要内容，是构建社会主义和谐社会的需要。但现行村民自治制度运行存在诸多弊端：自治权的界限不清楚，行使自治权的程序不规范，解决争议的方法不明确，权利保障不得力，村民自治与乡镇政府间的关系不明确，乱用权利的情况时有发生．这些问题要想得到根本解决，必须在立法上明确村民自治机构、自治权的范围和行使自治权的程序，强化监督工作，理顺各种关系，打击妨害村民行使自治权的黑恶势力。本文试图从法治的角度，探讨村民自治制度的完善，并就此提出自己的一些看法。

Discuss the perfect of farmer autonomy in China

In China, farmer autonomy is a great right of farmer endowed by constitution, it＇s the necessary of constitutionalism, is the important content of the construction of socialism new countryside, is the need of building a harmonious socialist society. But now the malpractice exists in its operating： the bound of farmer＇s autonomy is not clear; the procedure of its running not guided by law; the resolution of its disputes not definite; and no law to guide the relationships between farmer autonomy and the township government. These problems＇ solving must run the way of legislation, defining the organ of the farmer autonomy, the bound and the procedure, strengthening the supervision and rationalizing the relations. From the perspective of the law, this paper probes into the perfect of the farmer autonomy and some suggestions will be put forward.
