| 摘 要： | 学界多年来针对事实推定的探讨，往往执着于事实认定结构之单一维度来展开论证。但实际上对于一个法律概念而言，这个单一维度其实是不重要的，更重要的在于其法律后果。从法律后果角度来看，所谓事实推定在我国现行法律概念体系中并无存在的必要性，因其与间接证明均不存在差别。

| Abstract: | For many years, the investigation on the presumption of fact has been focused on the single dimension of the structure of fact finding. But in fact,it is not the single dimension but the legal consequence that is more important to a legal concept. From the perspective of legal consequences, there is no reason for the existanee of the concept of presumption of fact in China＇s current system of legal concepts, because there is no difference between indirect proof and presumption of fact. |
