| Abstract: | On the basis of comparison between influences exerted by the "Human - based Theory" of China traditional political philosophy on Chinese legal philosophy and that by humanitarianism in the westem philosophy on western jurisprudence, the author discusses the impact that the human - based development view has made on the change of China legal philosophy and proclaims that the human being should be the principal premise, the fundamental criteria and ultimate destiny of socialistic democratic and legal construction. |
