Judicial Strategies in National Governance:Against the Background of Rural Areas in Transition

In China’s transitional period,the background of judicial strategies arises from the retrogression of traditional governance in rural areas and the needs to solve disputes.In order to adapt to the actual requirements of social transition,Chinese judicial authority’s strategies should emphasize the compatibility of harmonious society and rule of law society,its methods should be "grand mediation" and "judicial activism".Correspondingly,folk strategies should emphasize judicial "inside systems" and "outside systems".All these judicial strategies combine all the wisdoms and benefits of different dispute resolution,and establish a dispute resolution "matrix".This matrix is soothing justice,which will supplement social resources,bear public responsibilities,strengthen joint governance,and ensure social stability.
