家庭法介入家庭关系的界限及其对婚姻家庭编实施的启示

There is a clear distinction between family law and family life.The intimacy and ethics of family life determine the limited scope of family law’s interventions in family relationships,and the law shall reserve sufficient space for family self-management.Based on the interaction between family law and family life,family law should adopt the mode of purposive abstention to intervene in family relationships,so that the state can intervene in citizens’family life at the legal level in a targeted way.When the family relationship falls into crisis or even breakdown,or affects the third party,or violates the bottom-line morality such as protecting the vulnerable groups in the family,the intimate environment of family life gives way to the needs of the rights and obligations of the parties concerned,and the family law can intervene in a targeted manner.The boundary of family law’s interventions in family relationships provides a theoretical source for the specific provisions of the Marriage and Family Book in the Civil Code,which should be used as a guide to promote the interpretation and application of the norms,and maintain its firmness and tension in dealing with relationships with other Books,so as to jointly promote the Civil Code to provide the people with the solid protection of rights and interests.
