| 摘 要： | 文章从分析法律移植与中国法的国际化进程 ,法律移植与国家主权、国家意识形态、中国法的本土资源以及立法成本等关系入手 ,指出法律移植是世界法律发展的一个基本历史过程 ,是法律发展的规律之一。文章最后对法律移植与 2 1世纪中国法的发展作了展望。

On the Transplantation and Naturalization of Law |

| Abstract: | Based on analyzing the relationship between legal transplanting and other social phenomena including the globalization process of the chinese law,the national sovereignty,the national ideology,the native resource of the chinese law and the legislation cost,the article then points out that legal transplanting is the basic historical course of the world-wide legal development and also is one of the rules of the legal evolution.At the end of the article,the author tries to make prediction about the influence of the legal transplanting and the movement of the Chinese law in the 21st Century. |
