宪法解释案例实证问题研究

全国人大常委会法工委有关扩大宪法效力、公民选举权的行使、裁决立法冲突等宪法解释案例，尽管不是宪法规定的宪法解释，但其作用与正式的宪法解释并无实质性的差异，弥补了正式宪法解释缺位之不足而构成中国宪法解释的惯例。宪法上的宪法解释与现实中的宪法解释之间的距离，有助于认识和理解中国宪法之外的宪法解释机关对宪法进行解释的实际情况，以及宪法实施过程的特点。

Cases Studies on the Constitutional Interpretation of China

That the constitutional interpretation cases regarding to extending the availability of constitution, to exercising the elective right of citizen and jurisdiction of legislative conflicts between law and local regulation in the paper ,which issued by the legal staff committees of standing committees of NPC, are not the official constitutional interpretation in China's constitutional systems and academic theory, but they still constitute one of important parts of China's constitutional interpretation cases, for their legal role not only as same as those of the constitutional interpretation from the standing committee of NPC which has the constitutional interpretative power ,but also filling lacks for official constitutional interpretation case in reality . From the distances between constitutional interpretation cases from standing committees of NPC in constitution and existing constitutional interpretation cases from the legal staff committees of standing committees of NPC,we can understand the actual operation of China's constitutional interpretation is beyond to the China's constitutional arrangements , as well as the characteristics of China's constitutional enforcements in reality.
