现代社会,软法在人们生活的各个领域大量出现,并呈现不断发展、增长的势头,其对公民、法人和其他组织的权利、自由产生了越来越重大的影响。软法在规范人们行为和调整社会关系方面,既有积极的作用,也有消极的作用。人们要抑制其消极作用,充分发挥和利用其积极作用,就必须通过硬法对软法的创制和实施进行规范;保障社会共同体成员对软法创制和实施过程的广泛和直接参与;保证国家和社会对软法创制和实施过程的全面和有效监督。

In order to control its negative effects and make full use of its positive effects, people should regulate the enactment and the implementation of soft law through hard law; safeguard community members' abroad and direct participation in the process of the enactment and the implementation of soft law; assure that the state and the society supervise the process of the enactment and the implementation of soft law completely and availably.
