论民事审判监督制度之完善

现行民事审判监督程序运行中存在着"再审难"与"再审滥"的困局。为此,民事审判监督程序的再次修订需要调整建构的理念,准确定位审判监督程序的性质,坚持辩证施治的方针,注意平衡各种相关价值,同时在此过程中处理好相关的几对关系,并对当事人申请再审条件、启动再审主体、管辖、再审审理程序等方面的规定予以合理化改造。
