行政罚款是遏止违法违规行为及其危害的一项重要法律制度。但目前在我国 ,行政罚款基本上处于一种“无章可循”的状态。本文对该领域存在的各种主要偏差进行了检讨 ,参考美国侵权法中的汉德公式提出了一种处理行政罚款的新思路 ,以使行政罚款在我国更加合理有效、更充分地实现它应有的功能和作用。虽然该公式尚未被系统地应用于美国侵权法之外的其他领域 (因此 ,本文提出的在行政罚款方面应用该公式的思路无论在美国法还是中国法领域都是一种新的尝试 ) ,但它可以被用来确定行政罚款的标准和具体数额 ,为我们更合理地管制有关生产和社会活动提供一种新的思路与理论指导

The Criterion of Administrative Fine: A New Way of Thought

The system of administrative fines is an important device for deterring illicit behavior and the risks associated therewith. Yet in China, administrative fines are without any meaningful, principled guidance. This article provides a critique of the current problems in this area and, based on the Hand formula from American tort law, proposes a new and more suitable way for handling administrative fines so that they become more rational and effective, and better realize their proper functions.
