也论生态整体主义环境法律观

地球生态系统的整体性促使以应对现代环境危机为历史使命的现代环境法从个体主义走向整体主义，但这并不意味着现代环境法对“生态整体主义”的全盘接受。整体性的生态系统在环境法上只能体现为人类整体的利益，意味着人类个体应当负有对其进行保护的义务和责任。当然，环境法对人类整体的利益保护并不意味其要杜绝与消灭人类个体的利益，而是要对其进行约束和限制。在人类个体利益仍居主导地位而人类整体利益观念尚未形成的当今时代，现代环境法制的健全与发展还有很长的路要走。

Of course, environmental law protects the interests of humanity as a whole does not mean to eliminate the interests of the individual human being, but to constraint it. Today, under the condition of that the human individual interests hold a dominant position and the concept of universal human interests has not yet formed, the integrity and development of the modem environmental legal system need to be a very long way to go.
