| 摘 要： | 船舶碰撞法新形态的生成背景是国际上一系列关于油污损害赔偿立法,并且形成了海上油污损害赔偿的法律体系。船舶碰撞法新形态,标志着传统船舶碰撞法律体系和海上油污损害赔偿法律体系的分离。船舶碰撞法新形态的生成具有应然性,同时也昭示了里斯本规则在船舶碰撞法新形态下的普遍适用性。在此背景下,创设“海事侵权”概念成为构建船舶碰撞法新形态的基本要素。
