法律修辞在中国兴起的背景及其在司法审判中的作用

中国的社会转型使我们处于一个高度不确定的风险环境中，这为以不确定性因素为逻辑起点的法律修辞研究提供了丰富的现实土壤。但法律修辞学在中国学界被热捧的理论基础，并不像它在西方社会复兴时那样坚实。当前中国社会并没有经历法律形式主义极度发达的严格法治时代，没有形成严格守法的习惯，缺乏遏事遵守规则的意识。因此，立足于省略三段论推理、强调理性说服功能的法律修辞研究，必须在崇尚程序规制的法律论证框架下使用，才能坚持司法审判的首要目标是依法正确判决，然后才是通过修辞的合理包装送达当事人和社会。

The Background of Legal Rhetoric Arising in China and It’s Function in the Judicial Process

We are in one high uncertain risk environment in the period of social change in China.It offers prolific practical soil to legal rhetoric researching which take uncertain factor as logic start.But the theoretical foundation of legal rhetoric in China is not as stable as it in the west.China society has not one strict law times which should have extra developed legal formalism conception.China society has not one custom which tell us strictly abide by law.China society has not one consciousness which tell us strictly toe the mark.The legal rhetoric researching take enthymeme reasoning as logic start,and emphasize rational persuade function.The legal rhetoric researching must be used in the frame of legal argumentation.Only in this way,can we insist that the chief goal in the judicial process is rightly judge according to law,and the following goal is that we send the right judge to parties by rational rhetoric packing.
