论我国的法律文化

人类社会发展至今，形成了人治主义法律文化与法治主义法律文化两大类。中国封建社会的人治主义法律文化，在相当长的历史阶段内，属于先进文化；滥觞于古希腊，成型于近代西欧资产阶级革命时期的法治主义法律文化，历时三百余年，总体上说，也属先进文化。中国近代社会通过艰难的抉择，走上了民主共和的发展道路。1998年我国现行宪法确立我国实行“依法治国”的治国方略，这标志着中国法治主义法律文化发展进入了一个崭新的阶段。中国社会与西方国家，无论从历史发展还是现实状况，都存在很大的不同，中国必须建设具有中国特色的法治主义法律文化。我国法治主义法律文化是当今宪法所确立的、正在持续发展的、不断完善的先进文化。

On Chinese Legal Culture

In development of human society so far, there are two major categories legal culture by rule of man and legal culture of the rule of law doctrine. In a fairly long historical period of Chinese feudal society, legal culture by rule of man belonged to the advanced culture. The legal culture of Legalism is also the advanced culture, which originated in ancient Greece and formed the modem bourgeois revolution in Western Europe. Through a pain- ful choice in Chinese society, the path of development of democratic republic is chosen. Until 1998 the statecraft ＂ governing the country in accordance with the law ＂ was formally put into Chinese current constitution, this indicates that the development of Chinese legal culture of Legalism has entered a new phase. Because of the difference between historical situation and the actual situation, constructing the legal culture with Chinese characteristics legalism is the only choice. The legal culture of Legalism is the advanced culture, which is established by Chinese constitution, being continued constructing and constantly improving.
