| 摘 要： | 我国《行政许可法》的颁布实施在一定意义上具体发展了政府法治，同时也发展了“非行政许可审批”这项长期为学界忽视的制度。然而实践中，非行政许可审批范畴的不确定、程序的不规范、责任的不明确等问题却在一定程度上消蚀着《行政许可法》的制度力量，甚至成为行政许可制度的掣肘性因素。

| Abstract: | The promulgation and enforcement of Administrative License Law moderately improves the specific practices of China＇s administrative law. At the same time, it promotes the practices of non - licensing approval system, the theoretical research of which has been neglected in the academia for a long term. However, because of the theoretical disadvantages of the non - licensing approval system, such as the uncertainty of its combines, the nonstandard procedure, and the ambiguity of its responsibility, are embarrassing the Administrative License Law in a certain extent, and even essentially. |
