法律监督理论下检察权的配置

研究检察权的配置应当从我国检察机关的法律监督功能切入。单一制国家的“大国司法”，由上而下的“推进型法治”，公民缺乏监督意识，议行合一的宪法体制，强大的行政机关，导致我国有必要将检察机关定位为专门的法律监督机关。这也决定了我国法律监督以制约行政滥权为重要目标，因此应确立行政公诉制度，加强侦查监督，维持并弱化审判监督。为实现法律监督功能，应当采取检察一体化，但应当注意检察机关内部配置检察权的分权。

The Distribution of the Procuratorial Authority on the Theory of the Legal Supervision

The study about the distribution of the procuratorial authority should be conducted from the perspective about the legal supervision function of our country＇s procuratorial organs. The single national system of ＂the grand national judicature＂, the progressive ruling of law of the supervision awareness, the combination of the discussion and execution for legal system, and the powerful administrative organs make it necessary to take the procuratorial organs as the professional legal supervision organs. These also determine our country＇s legal supervision which taking the abuse of administrative authority as the main target, so we should establish the executive public prosecution system, strengthen the investigation supervision. So as to realize the legal supervision function, the integration of the procuratorial organs should be carried out with awareness on the distribution of the authority within the procuratorial organs.
