| 摘 要： | 司法理性的主要语义是指法官的理性，另一种语义是指司法制度的合理性。对司法理性的特征进行研究有助于对概念的进一步界定：目的性是司法理性的首要特征，确定性是司法理性的价值取向，实践性是司法理性的本质，保守性是司法理性的内在特征，论证性是司法理性的外在特征。

| Abstract: | The basic meaning of judicial reason is a judge＇s reason,the other meaning of judicial reason is the reason rationality of judicial system.Researches into the feature of judicial reason is helpful to reach a definition of judicial reason clearly：Objectivity is the basic feature of judicial reason, and consistency is the value-orientation of it,the nature of judicial reason is practice,conser-vatism is the internalized feature,and argumentation is the external feature of judicial reason. |
