| 摘 要： | 宽严相济刑事政策的提出、恢复性司法及社区矫正的推行,体现了我国刑罚的轻缓化趋势和刑罚权动态的趋于理性,而社会背景的影响、国家治理和社会控制的转型以及刑事法角色的转变,是促使当今中国刑罚权动态转变的重要因素。认真分析和考量这些影响因子,有助于从社会的视角审视和规制我国刑罚权的运行。

| Abstract: | Some progressive logos and systems indicated the tendency of penalty reprieve and the rationality of power of penalty such as criminal policy of temper justice with mercy,restorative justice and community corrections.These factors prompt the running of power of penalty more cautious including effect of social background,transformation of state governance and social control and the change of role of criminal law.With analyzing and exploring these factors seriously,we can scan and regulate the running of power of penalty in out country. |
