| 摘 要： | 行政听证制度在资本主义法律体系中占有十分重要的地位,我国自1996年在相关法律中建立听证制度以来,其价值已初步显现。新颁布的行政许可法在听证制度的设定上有了一定的进一步,主要体现在听证参与人、听证笔录的效力以及保障听证权利的实现等几个方面,但在某些听证程序方面,如听证的启动、听证主持人的资格、质证、听证与复议的衔接等方面还没有规定,本文主要从这些方面对健全我国听证程序提出了建议和设想。

| Abstract: | The administrative hearing system plays a very important role in of the perfect law system a country.Sincet our country established the hearing system in the law of administrative punishment,the value of the hearing system has been proved.The law of administrative permit issued last year maes it go further.Through analysis of the hearing rules stipulated in the main laws and regulations,the paper will discuss into the hearing procedure,the hearing parties,the legal statues of the hearing host, between the hearing and reconsidering and so on in order to inquire how to establish our administrative hearing system. |
