调解本位主义及其制度选择——关于现行民事诉讼中调解优先模式的法理解读

调解优先模式的确立,标志着民事诉讼中调解本位主义的回归与复兴.本文考察分析了影响调解模式选择的现实因素,揭示了调解本位主义在中国社会籁以生长的实践土壤和制度运行的可用资源;通过对传统文化基因的分析,揭示了调解本位主义具有的民族特色和依存的文化根源;通过对司法场城中自治与强制关系的分析,揭示了调解模式具有的法治内涵.此外,本文还从法律效果和社会效果相统一的角度,分析了判决模式和调解模式在司法实践中的消长关系.在此基础上论证了调解本位主义作为民事诉讼的制度模式在中国走向法制现代化过程中选择和复兴的必要性和必然性.

On the Intermediation Standard and Its System Choice——About the Jurisprudence Interpretation of the Intermediation Priority Model in the Present Civil Procedure

With the establishment of the intermediation priority model,the intermediation standard in civil procedure returns and re- vives.However,the intermediation priority is criticized.In this paper,by analyzing the present factors on influencing the intermediation model choice,discloses the intermediation standard existing the soil and its system operating available resources in Chinese society. By analyzing the traditional cultures gene,reveal the intermediation standard as the legal phenomenon possessing the national char- acteristics and depending on the cultural roots.By analyzing the relationship of the self-government and the enforcement in the ju- risdiction,bring forth the intermediation model having the regulatory connotation.Moreover,this paper also analyzing the mutual rela- tion of the judgment model and the intermediation model throughout the perspective of the unification between the legal effect and social effect.On the above,the conclusion may be the necessity of the choice and the renaissance for the intermediation standard as the civil procedure model during China experiencing the law modernization course.
