关于我国民事再审程序指导思想之反思

“实事求是、有错必纠”是我国民事再审程序的指导思想。但是实践中一直不能解决的“申诉难”、“再审滥”等问题的存在却一再对该原则提出质疑。原因是通常所谓的“实事求是、有错必纠”原则在民事司法中缺乏现实基础和具体操作性;进一步,真正的“实事求是”要求尊重民事诉讼的独特规律,对生效裁判错误区别对待,而不是机械地“有错必纠”。总之,民事再审制度之改革与完善,要求我们必须对这一原则进行重新认识和创新

Reflection on the Guiding Principle of Our Country's Civil Adjudicatory Supervision Procedure

To seek truth from facts,to rectify whatever is wrong" is the guiding principle of our country's adjudicatory supervision procedure.But the existing problems,such as"difficulty of complaint","abuse of retrial",which haven't been solved till now in practice,challenge the principle often.The reason is that the principle of so-called "to seek truth from facts,to rectify whatever is wrong" is impractical in adjudicatory practice;Furthermore,the true "to seek truth from facts" requests the special law of civil proceeding should be paid attention to,and the errors in the effective adjudicatory should be handled on its merits respectively,not "to rectify whatever is wrong" mechanically.In a word,the reform and perfection of civil adjudicatory supervision demand the reconsideration and renewal of this principle.
