| 摘 要： | 目前我国城市房屋拆迁主要存在补偿偏低、政府越位、强制拆迁和救济不力等问题。而这些问题症结在于城市土地国有、政府扶持和法律关系错乱。因此,我国应当完善法律,明确政府定位,尊重保护私有财产权。

| Abstract: | At present,the low compensation,the displacement of government,the forced dismantlement and the short of relieve have become the major problems the in housing dismantlement.The crux of these problems is the state ownership of land,the support of the government and the disorder of the law relation.Tt is necessary to improve the law,define the role of the government and respect the personal property. |
