行政立法中责任条款的重构

行政立法是我国立法活动的重要组成部分，但行政立法中的责任条款却存在着责任主体的单一性、责任内容的片面性、责任体系的操作性不强等先天不足的问题。因此必须以正确的理念为指导对其进行重构，文中提出了重构的立法建议：改革现行的行政立法制度，发挥人民群众和其他组织在行政立法中的作用，实现法律上的程序公正；明确法律责任的承担主体、凸显行政机关及其工作人员的责任；完善行政立法中的责任体系、增强其责任条款的可操作性；围绕职权与责任的统一，重构行政机关及其工作人员的法律责任。

On Reconstructing the Clause of Responsibility in Administrative Legislation

The administrative legislation is an importance element of our country＇s legislation.But there is a lot of problem about its clause of responsibility in the administrative legislation such as：single of its subject,unilateral of its content,non-operation of responsibility clause and so on.So we must reconstruct its clause of responsibility by the right ideal,and the author put forward a few proposals as follows：Firstly,we ought to reform the system of the administrative legislation,and make good use of the people and the organizations,and realize process justice ;Secondly,we should definite the subject of responsibility and stress the responsibility of administrative organ and administrative personnel;Thirtly,we should perfect the system of responsibility,and strengthen operation of the clause of responsibility;Fourthly,we should reconstruct the responsibility of administrative organ and administrative personnel on the ground of the unity of power and duty.
