| 摘 要： | 法律推理是民法适用的一种重要方法。笔者在对法律推理进行一般性描述的基础上 ,对演绎推理、归纳推理、类比推理三种推理方式在民法适用中的具体运用展开讨论。笔者不仅对三种推理形式在民法实务中若干值得注意的问题进行了分析 ,而且通过民法实务中对三种逻辑工具的运用在观念上的变迁 ,揭示出从近代民法到现代民法的发展脉络。

| Abstract: | Legal reference is an important method to application of civil law, the author dealt with three methods of derivative reference, inductive reference and analogous reference practically applied in the civil law on the basis of generally describing the legal reference. In addition, the author mostly revealed the regularity of development considering the late civil law to modern one. |
