侦查机关内设鉴定机构的负面影响与消解

Adverse Effects of Setting-up a Forensic Institute within the Investigation Agency

Distinctness of investigative activities tends to results in recourse to forensic science,which articulates to some extent why forensic identification institutions are set up within investigation agencies. However,since investigation is of somewhat prosecution color,it is hard for the forensic institute set up within the investigation agency to maintain neutral and thus is inconsistent with the requirement of law and bound to have some adverse effects in proceedings. The reform of forensic identification system tends to separate the identification institute with investigation activities while reinforcing uniform judicial administrative regulation over forensic identification,as such,the forensic institute may,comparatively,maintain independency. Thus,the tension may be eased with external supervision and structural regulation and the forensic identification institute can exert its actual role in criminal proceedings to conduce finding the fact.
