情事变更原则:统一合同法面临的立法与司法问题

本文在揭示情事变更原则的现实和哲学根源及其法律本质的基础上，结合大陆法系主要国家的有关立法情况和司法实践，对我国新出台的合同法关于情事变更原则的规定加以剖析；探讨了情事变更原则与诚信原则、不可抗力制度体系的相关性及法律功能的分配，认为我国合同法在此存在着法律的漏洞，并提出了弥补建议。

Legislative & Judicial Problems Confronting Uniform Contract Law

Based on the study of the reality,philosophical origin and legal characters of the principle of “rebus sic stantibus”,the author analyzes the relation between rebus sic stantibus and bona fida principles in Chinese Contract Law as well as force majeure and some legal loopholes from the perspectives of the legislation and judicial practice.
