《劳动合同法》实施中的工会工作

工会作为职工利益的代表者和维护者,虽然不是《劳动合同法》的执法主体,但《劳动合同法》在许多条款中赋予了工会代表权、参与权、监督权等。因此,一方面要发挥好工会在《劳动合同法》中的指导、表达、维护、制约和协助作用,加强和完善工会在《劳动合同法》中的职责;另一方面要努力创造工会在《劳动合同法》中的权利和作用实现的条件。同时更要从劳动合同的订立、履行、变更、解除、终止,到有关违约金、补偿金和赔偿金的给付过程中,为职工提供法律、政策等帮助和指导。

Work of Trade Union in Implementation of Labor Contract Law

Labor contract law makes the rights of representative,participation and supervision definite for trade union organizations.In the course of operation of labor contract,the trade union organizations should create conditions to play an active role that features guidance,expression,protection and supervision.
