警察职权的范式建构

警察职权在世界警务改革中日益受到关注 ,中国警察在职权的行使中尽管绩效显著 ,但仍因相关理论的匮乏而导致其具体的原则不甚规范。英美、大陆两大法系在警察职权的规制上各有优长。大陆法系以法律明文规定的方式使警察职权的种类、原则、程序明确化 ,重在结果 ;英美法系侧重职权行为过程 ,通过合理设计程序 ,增进效率。警察职权范式应是一定时期内警察科学共同体普遍承认的科学成就 ,是对警察职权的优化组合。我国警察职权的范式应该从警察职权的分类和原则着手建构。

Construction of the Standard Police Authority of Office

Police authority of office is becoming increasingly a concemed issue in the police reforms worldwide. Based on the studies of the situation of the present Chinese police authority and knowledge of American and European law systems, this article aims to seek the possibility of constructing standard police authority of office. That is, ist is keen on teconstructing the police authority of office, making it a well-recognized scientific achievement in the police science circle. It is certain that this must be based on the scientific researches of the administrative laws.
