我国黑社会性质组织犯罪研究

黑社会犯罪与有组织犯罪是两个不同范畴的概念 ,前者揭示的是犯罪的社会形态 ,后者仅反映犯罪的组织形态。黑社会性质组织是指初具一定社会结构、功能和运行方式的犯罪组织 ,是由有组织犯罪中高级组织形态社会化演变而来 ,并向着黑社会犯罪演进的雏形形态。黑社会性质组织犯罪与黑社会犯罪同“质”不同“量”,与有组织犯罪同“形”不同“质”。黑社会性质组织犯罪具有犯罪社会性的组织结构、犯罪社会化的经济扩张、社会公共领域的渗透和称霸一方的反社会本质等四个方面的基本特征 ,其产生原因主要有社会现实因素、历史文化因素和境外黑社会犯罪的渗透影响等。

Research on the China's Crime of Criminal Syndicate

Gangland crime differs from organized crime in which the former reveals the social formation of crime while the latter reveals the organization formation of crime. Mafia-style crime refers to the criminal organization with certain basic social organization, functions, and operating pattern, which is an embryonic form evolved from the advanced form of organized crime and is to develop into gangland crime. Mafia-style crime differs from gangland crime in quantity whereas it differs from organized crime in quality.Mafia-style crime is basically characterized by institutional framework, economic expansion of socialized crime, undergoing public areas, and anti-society by seeking hegemony, which is mainly due to social, historical and cultural reasons and evil impact of foreign gangland crimes.
